The Congressional Leadership Wants to Suspend the Rules so our
Representatives won't know what they are voting on. Some in Congress are
speaking up. They need to hear more from us.

Our latest information is that the Department of Defense Appropriations
Bill Conference Report has been completed and will be filed within the next
couple of hours. We are informed that the bill definitely contains some
appropriations of money for avian flu vaccine development but LIABILITY
LANGUAGE WAS KEPT OUT of the bill! Agreement on compensation language
could not be worked out so immunity for drug companies was kept out of the
bill.

The bill hasn’t been filed yet so we can’t independently confirm this
information. We have been told to watch the Authorization Bill and Budget
Reconciliation too. The problem is getting copies of the bill drafts.
Congressional Leadership is hiding them from the public and even from their
colleagues in Congress. We think the Senate vote on the Department of
Defense Appropriations will take place tomorrow so there is still the
chance that a Senate "leader" will force sneak the liability language back in.

The calls, faxes, emails -- the pressure -- is working. Believe it or not
a group of parents with sick children is beating back the Pharma lobby and
the Congressional leadership. If we do, it won't be the first time, and it
won't be the last, because we have no choice to keep fighting for our
children's lives.

If we can get past these shameful secret legislative maneuvers we can beat
the Bozos. The Congressional leaders know immunity legislation for drug
companies cannot pass on their own because such legislation cannot
withstand public scrutiny. The American people will not stand for it.

I respectfully request that you act to protect the rights of
vaccine-injured children by opposing the unfair liability immunity giveaway
proposed for drug companies.

There are ten or more bills pending in Congress that contain language that
severely limits the rights of children injured by vaccines. I am shocked to
learn that one of these provisions may be slipped into proposed legislation
– the Department of Defense Appropriations Bill Conference Report - in a
manner similar to the provisions snuck in the dead of night into the
Homeland Security bill in 2002. If any of these provisions is enacted, a
vaccine-injured child's right to have his or her day in court will be
unnecessarily and unfairly taken away. Enactment of this legislation will
be a dark day for the tradition of fair play and equity in the American
justice system, not to mention that such action will violate the Seventh
Amendment’s preservation of every American’s right to a jury trial.

As a voter who cares deeply about children injured by vaccines, I oppose
legislation that will provide unprecedented immunity to a vaccine industry
that has caused tragic injury to some children. Such liability protection
is unnecessary. There has been minimal number of vaccine lawsuits over the
past 30 years - current laws adequately protect vaccine manufacturers. The
apparent lack of vaccine manufacturing capacity in our country is not due
to lawsuits but to other causes, such as the consolidation of
pharmaceutical industry via merger and market factors that pose economic
barriers to vaccine production. Liability concerns have little to do with
vaccine manufacturing problems — eminent public health experts like the
NIH’s Dr. Anthony Fauci and Dr. Walter Orenstein, formerly of the CDC’s
National Immunization Program, have said so. Liability is not the problem.

In addition, representatives of biotechnology companies have through the
use of the latest technology that eliminates dangerous protein contaminants
vaccines can be produced more safely than through the methods used by the
major drug companies. These biotech companies say that they do not need
liability protection in order to move ahead to manufacture the new
generation of safe vaccines. Biotech firms using new technology have
sufficiently high confidence in the safety of their product that they are
not worried about lawsuits.

I urge you to place the interests of injured children above those of the
pharmaceutical industry. Along with many of voters across the country, I
am deeply concerned that should unnecessary liability protection be enacted
vaccine manufacturers will cease to have an incentive to make their
products safe. Lack of vaccine safety endangers all Americans.

Please act to protect Americans and ensure that safety is our vaccine
program's highest priority.

WASHINGTON, Dec 19 (Reuters) - The U.S. House of Representatives early on
Monday approved $3.78 billion to begin preparations for a possible avian flu
epidemic. The bill would also shield manufacturers of vaccines and drugs
from lawsuits during an epidemic.

The legislation, wrapped into an unrelated defense bill, still faces an
uncertain fate in the Senate later this week.

The money would be used for stockpiling potential vaccine and drugs,
training emergency officials and increasing international surveillance of
the flu which has been sweeping through poultry flocks in Asia and more
recently into eastern Europe.

The deadly animal disease has infected at least 139 humans, killing about
half and scientists fear that if the disease becomes more easily transmitted
to humans, a pandemic could unfold, killing millions across the globe.

Conservatives balked at spending so much money so quickly, and without
making other cuts in the budget, at a time of deep deficits and huge
expenses for Hurricane Katrina recovery.

Following late-night negotiations between top Republicans, Senate Majority
Leader Bill Frist of Tennessee succeeded in including a provision to protect
vaccine, drug and medical device makers against civil lawsuits if the
products were used in a pandemic or epidemic.

Consumer and health groups opposed the vaccine liability provisions, which
were sought by pharmaceutical companies, saying it would protect companies
from "gross negligence."

Some lawmakers said the measure could make medical personnel and other
emergency workers reluctant to get vaccinated if there was a chance they
could suffer negative reactions and not get compensated.

"The Republican leadership ... get everything on their wish list, but
nurses, firefighters, and ordinary Americans who will have to take untested
vaccines and drugs get no money for compensation if they get injured," said
Massachusetts Democrat Edward Kennedy.

The legislation calls for a compensation fund but does not authorize any
money for it. The bill "gives carte blanche to the vaccine companies, but
doesn't provide a mechanism" for people if they are injured by a
vaccination, said Rep. Dan Burton, an Indiana Republican.

The money was about half the $7 billion the Bush administration had
requested. Earlier this year, the Senate passed legislation calling for $8
billion in funds to prepare for an avian flu pandemic. But conservative
Republicans in Congress opposed the higher spending, citing concerns about
the huge U.S. budget deficit.

Senators Would Profit from Bird-flu Bill's Drug Co. Shield

Dec 20 - Charging that nearly half of the Senate is personally invested in
drug corporations that stand to gain from a measure under consideration, a
consumer organization yesterday called on lawmakers to nix a peculiar
immunity clause from a "must-pass" defense spending bill up for
consideration this week.
Until the House of Representatives approved liability protections for the
pharmaceutical industry as an amendment to the defense appropriations bill
early Monday, opposition groups had been successful in beating it back.
Under the measure, the federal government will invest about $3.8 billion for
vaccine development and other pandemic and biological attack preparedness
efforts, about $3.3 billion of which will go to the Department of Health and
Human Services for drug purchasing and response planning. Additionally, if
the amendment in question becomes law, companies will be granted immunity
from lawsuits over adverse effects from drugs deemed necessary to combat a
public health threat.
In a statement yesterday, the Foundation for Taxpayer and Consumer Rights
(FTCR) warned that the amendment's "language is so broad that any product
considered a 'countermeasure,' not just vaccines, could be protected."
Seeking to re-stoke resistance to the measure, FTCR also pointed out that 42
Senators - 27 Republicans and 15 Democrats - collectively hold over $16
million in stock in the very companies that the bill would place under
protection. The analysis includes immediate family members and is based on
the most recent public finance reports.
Senate leader Bill Frist (R-Tennessee) dismissed questions about the ethics
of approving legislation tied so closely to one's financial well-being, the
Chicago Tribune reported. "These provisions will ensure that we have the
capacity to develop products to rapidly protect the American people from a
bio-terror attack or flu pandemic," said Frist, who pushed for the provision
to be attached to the defense bill and is already under investigation over
possible ethics violations related to medical company stock he owned.
